1. Who we are

The barril.games website is operated by Barril Games Corp. ("Barril Games", "we", "us"), a Delaware corporation.

2. Accepting these terms

2.1 You accept these terms by using the website. If you don’t agree, don’t use it.

2.2 Our Privacy Notice explains how we handle personal data. It is a separate document and is not part of this contract.

2.3 If we later publish games or other services, they will have their own terms. Those terms apply to that service in addition to these.

3. Who can use the website

3.1 Age. You must be at least 18 years old to use the website and its forms.

3.2 Regions. The website is directed to people in Mexico, the rest of Latin America and the United States. It is not directed to people in Brazil, the European Union, the European Economic Area or the United Kingdom.

3.3 Restrictions. Don’t use the website if the law where you live does not allow it.

4. What the website offers

4.1 The website gives information about Barril Games, its team and its projects, and ways to contact us.

4.2 The information on the website is general and may change without notice. Except for section 4.3, it is not an offer or a promise of any feature or date.

4.3 Early access and download. If you join the waitlist, we will tell you when we open early access and when we launch the game. Early access depends on availability: it may have limited spots, open in stages, by country or by device type, and has no guaranteed date. Joining the waitlist does not guarantee you a spot. The game will be free to download in the stores where we publish it; it may include ads and optional in-app purchases, and it will have its own terms (section 2.3). We may change or cancel early access or the launch; if we do, we will tell you by email.

5. Waitlist and third-party forms

5.1 To join the waitlist, the website opens a Typeform form in another tab. Typeform and we both receive what you type there. We have no forms of our own on the website.

5.2 Typeform has its own terms and its own privacy notice. Our Privacy Notice explains what we do with the data we receive.

5.3 You can leave the waitlist at any time by replying to any of our emails or by writing to legal@barril.games.

6. Acceptable use

When using the website you must not:

1. 1. access or try to access systems, accounts or data that are not yours;
2. 2. interfere with the operation or security of the website, for example with attacks, viruses or excessive automated requests;
3. 3. scrape content from the website in bulk with bots or automated programs, other than ordinary search engines;
4. 4. pretend to be someone else, including Barril Games staff;
5. 5. submit false data, or another person’s data, in the forms;
6. 6. use the website for any unlawful purpose.

7. Intellectual property

7.1 The website, including its text, graphics, illustrations, logos, names and design, is protected by intellectual property laws and belongs to Barril Games or the respective rights holders.

7.2 You may view the website and share its links for personal, non-commercial use. Except for that, these terms give you no right over its content. For any other use, ask us for written permission.

8. Messages, ideas and suggestions

8.1 If you write to us, we will use your message to reply to you, as described in the Privacy Notice.

8.2 If you send us ideas or suggestions, we may use them without any obligation to you.

9. Links and third-party services

The website may link to third-party services, such as social networks or Typeform. They have their own terms, and we are not responsible for their content or practices.

10. Privacy and cookies

10.1 Our Privacy Notice explains what data we collect, why, and the rights you have.

10.2 Analytics and advertising-measurement cookies are only turned on if you accept them. You can change your choice at any time with the "Cookie settings" link at the bottom of the page.

11. Disclaimers

We work to keep the website available and accurate, but it is provided "as is" and "as available". To the extent the law allows, we do not guarantee that it will be uninterrupted or free of errors. This section does not limit any guarantee that the consumer law of your country gives you and that cannot be excluded.

12. Limitation of liability

12.1 To the extent the law allows, Barril Games is not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the website.

12.2 To the extent the law allows, our total liability to you for any claim related to the website is limited to USD 100.

12.3 These limits do not apply to liability that cannot be limited by law, including for intentional misconduct or gross negligence, death or personal injury, or rights that consumer law in your country protects.

13. Changes to the website and to these terms

13.1 We may change or remove parts of the website at any time.

13.2 We may update these terms. We will publish the new version with its date, and we will announce material changes on the website before they take effect. If you keep using the website after that date, the new terms apply. Changes will not apply to disputes that started before them.

14. Disputes and governing law

First, talk to us. Most problems can be solved quickly. Write to legal@barril.games with your name, your email and a description of the problem. We will try to resolve it within 60 days.

14.1 If you live in the United States

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute that we cannot resolve informally will be decided by the state or federal courts located in New Castle County, Delaware, and you and we accept their jurisdiction. Either of us may instead bring an individual claim in a small-claims court that has jurisdiction. Nothing in this section takes away rights that the law of your state gives you and that cannot be waived.

14.2 If you live in Mexico

These terms are governed by the laws of Mexico, including the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor). You can file a complaint with the Procuraduría Federal del Consumidor (Profeco) and bring a claim before the competent courts in Mexico. Nothing in these terms requires you to submit to foreign courts or to waive the protection of that law.

14.3 If you live in another country in Latin America

These terms are governed by the laws of the State of Delaware, United States, except where the law of your country of residence gives you protections that cannot be waived; those protections apply. You can bring a claim before the competent courts or consumer-protection authority of your country.

15. General

15.1 Entire agreement. These terms are the whole agreement between you and Barril Games about the use of the website.

15.2 Severability. If any part of these terms is found invalid, the rest stays in force.

15.3 No waiver. If we don’t enforce a right, we don’t give it up.

15.4 Language. These terms are available in English and Spanish. If you live in Mexico, the Spanish version governs. Otherwise, if there is a conflict, the version in the language you read them in governs.
